A Deeper look at Why There must be a Limit to the Supreme Court's Power
All animals are equal, but some animals are more equal than others
. When it comes to making attorneys obey the laws that rule over us all and the effort done by the Supreme Court, those words from the 1984 novel sums it well. It has twice been declared by the court within a span of two years that lawyers are off the hook from good government laws for the reason that in the state constitution, only the Supreme Court can act out rules for those serving as attorneys even as laws were not targeted to the practice of law and should be governing every single individual be they normal people or attorneys.
It's time for the legislature to act to restrict that power by beginning the process to strip the Supreme Court of its authority to regulate the legal profession in areas not directly related to the operations of the courts, and perhaps even there as well. It is very essential that lawyers are not allowed to make themselves exempt from the laws thus ascending beyond the governing bodies over regular citizenry so this has to be stopped even as senators and congressmen may not be so keen in fighting this hard battle.
A year ago, the top judges of the state were able to get rid of a lobbyist disclosure law since those who want to gain power over rules are actually attorneys. The Supreme Court said lobbyists attorneys must not obey all the laws and neither are they compelled to report who they lobby for and what they spend, or how much. And in another blow to good government, lately, the Supreme Court ruled 4 against 3 that lawyers are not subject to the state's revolving door law, which prohibits most public employees from representing private sector interests before the agency in which they formerly worked for one year. The idea is to limit insider information and undue influence.
Our senators and representatives may not relish taking on this fight but it's important if we are to stop the situation in which lawyers are more equal than the rest of us in that they are exempt from laws others must obey. With the effort of senate staff last year, a survey established that among the States, Pennsylvania alone had its high court exempt lawyers from abiding by laws that should apply to all
Never ever should we allow ourselves to be fooled into thinking the matter is not at all to be taken seriously in the midst of the Supreme Court institute lobbying or having for these lawyers, revolving door rules. We are a nation supposedly of equals. So no separate laws should govern regular people from the attorneys. The chief justice said in a speech before the local press club that he expects the court will announce new rules for lawyer lobbyists soon. However, this is not the proper cure for these rules will only affect lawyers in a land where the foundation is that under the law, everyone is supposed to be treated equally.
Some aver that once the process to strip the court of its exclusive power has begun, a constitutional crisis will certainly commence. There is no stopping this crises as n people who decided that common sense rules covering everyone in given circumstances could not be compulsory on lawyers in instances not directly related to the courts, specifically the very egotistical and selfserving justices have ignited it. If the Supreme Court cannot show restraint, then it's up to the rest of us to limit the power of the court so the basic tenets of our society, including equality under the law, are not threatened.
