American Warrants For Those Residing Abroad

warrants can affect individuals (both US Citizens and Non-US Citizens) abroad.

Few people like to think of the possibility of being the subject of any type of American warrant. There are various types of warrants that can be issued by Courts of differing jurisdiction in the United States of America. For instance, most jurisdictions in the United States of America follow some form of the English common-law. Therefore, legal instruments such as the Bench Warrant or the Arrest Warrant are commonly issued in American jurisdictions. Other types of warrants, such as Fugitive Warrants, are issued in less common situations where the subject of the warrant has apparently fled a jurisdiction.

For example, failure to respond to a routine traffic "ticket" could lead to a Court issuing a bench warrant for the subject of the original citation. An individual's failure to pay child support, or possibly spousal support, pursuant to Court order is one more common reason for issuance of a warrant while an individual is abroad. Increasingly, those with children in the USA will find themselves the unknown subject of a US warrant, often issued while the subject was outside of the jurisdiction, due to arrears in child support payments. This can be problematic for the subject of the warrant as many American Citizen Services Units at US Consulates and US Embassies abroad will not issue new US passports or add visa pages to old passports if the seeker of such services has an outstanding warrant in the USA. In fact, those seeking such services could have their US passport confiscated by American Consular Officers if an Officer determines that the individual at issue has an outstanding warrant.

Where an individual is outside of the United States and has an outstanding warrant it is advisable to contact an American attorney to discuss one's legal options. In certain instances, the reason for issuance of the warrant can be dealt with efficiently and the subject of the warrant may be granted a proper travel document. In other cases, intense legal counsel may be necessary in order for the subject to effectively deal with his or her problems in the United States. In any case, learning correct legal information and making informed decisions is often the best method of adhering to the law while safeguarding one's interests.
