This article looks at the importance and role of the accident report form, what happens if it does not get filled in and whether you are still able to make a claim. It also looks at common accidents in the workplace and what you should do if you have been injured at work. The role of the accident report form (or book) is to record details of the accident (such as circumstances, time, date, injuries sustained etc) and it is a useful document in a subsequent personal injury claim as it helps to clear up any issues regarding liability (i.e. whose fault the accident was) and confirms exactly what took place. The report is also useful to the employer in the event that the employee subsequently requires time off sick after the accident - the employer will have, already documented, details of what has led to this absence. So what if - for one reason or another - the accident report form is not completed at the time of the accident? This could be, for example, because the needs of attending to your injuries are at the time thought to be greater and the completion of the accident form gets overlooked. Although it is likely to be raised as an issue by your employer's insurance company, whom you are making the claim against, this issue is in no way insurmountable. You will be able to draw on the evidence of witnesses to the accident, the occurrence of any previous similar accidents, ambulance records, GP/hospital records and any subsequent HSE report. All of these things will help to support your account of the accident and the fact that there is not an accident report form in existence does not necessarily mean that you will not be able to make a successful claim. Accidents in the workplace are relatively common and vary widely in their nature. Typical accidents include a shop worker slipping on debris on the floor, an office worker hurting their back as a result of a faulty chair, a factory worker that has their foot crushed by machinery or a warehouse worker that trips on a hazardous wire. These are all examples of how injuries can occur in the workplace. If you have been injured as a result of an accident at work and do not think the accident report book was filled in at the time of the accident, do not worry. Simply request that it is done so as soon as you are able to contact your employer and seek the advice of an experienced work accident solicitor who will guide you through the process of making a claim.
