In a perfect world, both the mother and father would be completely satisfied and happy with the future living arrangements between them and their children. However, simply due to the nature of what divorce is, this is not an option. There'll be things that both parents must give up during this process.


If an agreement cannot be reached concerning the custody of the children in Canada, then of course the courts will take it upon themselves to decide these issues with respect to the best interests of the children involved. Even in this case, neither parent will be awarded 100% of what they are asking for. Oftentimes, a type of consultant is appointed by the court in order to go into each parent's home and evaluate the living arrangements between them and the children. This consultant, often called a child advocate, has much sway with respect to the court.

In most cases, the court will listen to the advocate and take their advice on how to establish the custody of the children. It is in the parent's best interest that they participate and interact with the advocate to the best of their abilities and provide the person with the best insights and picture of what life with them would be like. Without this service, the judge is simply left up to his own personal feelings in a very short court proceeding where he will decide the times and days the children will spend with each parent.
