Copyright law states that when employees construct a web design for a company they are employed by, the copyright of that web design belongs to the company, not the employee.

Copyright laws go into great detail; if there's no written agreement, royalty-free, non-exclusive licenses should often be enough. These licenses legally entitle web developers to maintain and upgrade a website. Although, if a lawsuit occursm the original designer will still be favored by the copyright laws.

The copyright laws state that the both the company and web designer can claim the copyright to the web design, if the design was copied from websites that are unprotected, by the web designer. As is also allowed by the copyright law, the designer can reuse and make additional improvement to the web design for any other customer. The fact that there must be the deletion of all the information that is confidential that has been given up by the last owner, is the only restriction.


There can be an argument between the website owner and the web designer, when payment is withheld for the work of design, by the owner. In these situations, the law protects the owner, especially if the amount is higher than $500.

Because of this, the web designer and website owner should enter into a legally binding contract that explicitly states both parties' rights. This sort of contract will prove greatly beneficial to the owner of the site and its designer.
