Defamation, Libel and Slander attorney
There are many ways a person can seek to harm another person and not always involving assault and battery type injuries. Defamation, libel and slander are all about attacking a person's reputation or name. Many times defamation cases are a challenge to prove even for the best of personal injury attorneys. Often the best defense is the simple proof of truth rather than a lawsuit that will only drag names through the mud and likely make the situation at hand worse. This is not necessarily true when it comes to all cases of defamation, however.
Defamation simply means the situation in which a statement or statements are made about a person that are not true with the intent to bring harm to the person being mentioned in the statements. Spreading lies and rumors about someone with malicious intent to their reputation and their name is an act of defamation. The specific actions of slander and libel are the ways defamation is perpetuated. These things are a challenge to prove, especially in the cases of slander. Libel can be a challenge as well but slander is typically harder to prove and punish.
Slander is a method of defamation in which the perpetrator seeks to harm the victim by spreading verbal falsehoods and untruths about them. When these things are done verbally it is slander. Slander must include third parties, it must be done publically in order to bring shame and harm to the person it is being done against. It is hard to bring charges of slander against a person because verbal attacks are difficult to prove much less to retract satisfactorily. Every situation with derogatory, hateful comments made about a person is not necessarily worthy of a lawsuit involving personal injury attorneys.
Libel is the other way defamation can be committed against a person. Libel is defined as slander or defamation that appears in print such as newspapers or magazines. This type of defamation happens most often to those people who are in the public eye such as celebrities and public officials of all kinds. There are successful libel suits that take place, especially when the truth is clearly shown. The punishment for the perpetrators in a libel suit are often compensation for pain and suffering as well as a formal, printed retraction that covers the same venue that the original print covered. Each individual case will determine whether or not the libel situation at hand is worth a lawsuit.
