The bail amount is set by the court judge who is guided by a set of factors that can affect the full amount of the bail. The term bail refers to the contractual agreement between the court and the defendant wherein it states that the defendant will be present at any of his or her court proceedings and trial date. This agreement helps the suspect to be released on bail instead of being imprisoned during the duration of his or her trial which in worst cases can last for several years. In order for the suspect to be released on bail, the court must be guaranteed that the suspect will show up and therefore they set up a monetary amount that must be paid by the suspect. If the suspects do not show up for his court dates, the amount will not be refunded.
However, there are times wherein the bail amount is too high for an average individual to pay. For this reason, the defendant's family members or their friends can contact a bail bonds agency who can help the defendants pay the full amount of bail. This process usually entails the defendant, family members, or friends contacting a bail bond agent who will then guarantee the court that the defendant will be present in all of his court dates. The bail bond agency will also require a certain amount of fee which is usually 10% of the full amount of the bail. The agency will then put up 90% of the bail bond. If the defendant is able to attend each of his or her court hearings, the amount paid by the bail bonds agency will be refunded and they get to keep the 10% as their service fee. However, since they run a certain risk that the defendant will jump bail, they usually require some kind of collateral.
Bail bonds agencies can also make the friend or family member a co-signer of the bail so that if the defendant jumps bail, the repayment of the bail amount falls on the co-signer. They also hire bounty hunters to look for the defendant and put him in jail if he or she decides to run from the law.
