Dui Probation- Understanding How It Works

DUI probation is usually given as a penalty for a DUI conviction

. The individual with this form of probation was found to be driving while under the influence of alcohol or drugs. The state where the crime is committed and the conditions of the crime will determine whether a DUI will be a felony or a misdemeanor.

Unfortunately there are several different things a person must endure when they are on DUI probation. It's possible that mandatory DUI classes and treatments for drug and alcohol abuse can be part of the punishment. When you complete these programs it can reduce the length of the penalty. This is why these programs are extremely beneficial. However, there are not an option for anyone who is a repeat offender.

During the DUI probation each person will be assigned to a probation offer. When this occurs the convicted individual must check-in regularly with his or her officer, which is mandatory. If they provide you with any instructions they must be adhered to or else a violation can occur. In fact, the probation officer will most likely contact your workplace or anywhere you may have commitments to just to make sure you are fulfilling your responsibilities.

The length of DUI probation varies between state and conditions surrounding the case itself. First time offenders can expect anywhere between 3 months to 1 year. While repeated DUI offenders or in cases where someone was injured, an aggravated DUI, the length will be much longer, from up to 5 years or more. Sometimes with an aggravated DUI an individual may first have to serve jail time, pay fines and then be placed on DUI probation.

It's also important to understand that driving privileges will vary as well. It's possible that you could have your driving privileges suspended. Then again, you could receive them back after certain requirements are met. You might even get to keep them after the probation hearing or have certain benefits like driving to and from work. If by chance you drive illegally you could be dealing with stricter penalties.

There is also another course of action if you're required to utilize an ignition interlock device. This is to help alleviate drunk driving and keep the public safe, which includes the driver. The way it works is an individual will need to blow in the device (breathalyzer) that is installed on the vehicle's dashboard. If at anytime the blood alcohol content is higher than .02% or .04% then the engine won't start. It's just another way someone can prove they are keeping up with the DUI probation requirements.
