Electronic Discovery: An Introduction

Electronic Discovery, or "e-discovery", is a process used by the courts to find information on a computer to use in a court case

. There are many different kinds of information that can be discovered electronically, some of which include e-mails, instant messaging chat logs, documents, spreadsheets, audio files, website history and picture files.

This is a more efficient way to gather and sort evidence than paper or human testimonial. No longer do you have to recall what a conversation was, it is stored on the electronic device. Sorting the papers is a thing of the past as well. Electronic discovery allows you to store the evidence the same way it was retrieved.

There is a new field for e-discovery. This field is called computer forensics. In this field, an investigator specializes in looking at the contents of a specific computer. They basically take the computer and then search through it so to not tamper with the evidence on the original hard drive. The original computer is then stored in a safe place.

Digital data that is found on computers is very easy to investigate. Data is never really deleted from a hard drive. There is really only one way to get rid of the information on a hard drive. So, if you're looking to hide something from getting electronically discovered, you should probably break your hard drive into pieces.


Many types of files can be used as evidence including picture, audio, and animation files. Email and databases are up for grabs, as well. Instant messages, texts, blog posts, and any computer programs can contain evidence, too. Anything contained within these can be used as evidence against you in court when you are accused of a crime.

The study in electronic discovery is ongoing and will continue to grow as technology improves. This field moves so quickly, but it can barely keep up with all the attacks and malware being created by hackers. Firewalls and malware protection programs attempt to prevent hackers from getting in, but the government can get past them.

Outside of the court system, you can use e-discovery for your own purposes. With clever hacking, you could find out if your significant other is cheating on you or if they are looking at child pornography. These are very good things to find out about your partner. If you can't trust them, who can you trust?

So find a little more information about electronic discovery and form some opinions of your own. It is important to be involved in any legal rules regarding something that most people interact with on a daily basis, like a computer and cell phone. Let people know if you feel like this invades and privacy or is constitutional.
