Employers are being advised to ensure their dress code does not exclude anyone on religious grounds.Research by XpertHR revealed that nearly nine out of ten employers with a mandatory workplace dress code in place takes special care not to discriminate against employees on the grounds of personal belief or religion.Xpert HR's dress code survey also discovered that the majority of employers ensure that their dress code does not ban any items that could have religious significance in order not to fall foul of legislation.British Airways (BA) avoided punishment when their employee Nadia Eweida lost her discrimination case against the airline after she claimed that she was suspended for refusing to conceal a crucifix under her clothing in 2006.The airline adapted its dress code the next year to enable their employees to wear religious symbols and Ms Eweida subsequently returned to work after this change was introduced.Xpert HR reported that almost one-third of employers discussed their dress code with employees while one-fifth sought the advice of legal experts in order to avoid a repeat of the BA situation.Charlotte Wolff, author of the report, said: "Although only a minority of employers do so, it is helpful to consult with employees or their representatives when drawing up a dress code to get an indication of any potential issues."Ms Wolff said that it was best business practice to communicate with employees the full appearance requirements in their dress code so that they can allow flexibility for cultural diverse or religious workers.With summer fast approaching, some businesses may feel the need to adapt their dress code in order to help their employees feel more comfortable in a warm workplace during the hottest months.Performance improvement consulting experts will be able to advice businesses how to implement the most effective workplace dress code.Employers should make their staff understand the difference between business wear and smart casual and provide examples so that there is no confusion about what is allowed in the workplace.Workers should also be aware of the potential for disciplinary action if they do not meet the basic requirement of a dress code as this will encourage them to remain smart all year round.Businesses can avoid sex discrimination allegation cases by applying their workplace dress code equally to all employees but they must ensure that the requirements are enforced consistently and fairly.
