False Claims For Compensation By Tenants Rights From Landlords
Tenants rights are being researched on the internet by tenants to unfortunately use
the information to take action against their landlords who deal with investment properties to make money. It is becoming more and more important as a landlord or agent to protect you by ensuring that notes are taken on every conversation had and kept in case needs of evidence in the future.
The someones fault culture is spreading across the country rapidly across all sectors and as money is tight, we are seeing more and more of this, so we need to take note and take action to protect ourselves and as agents, protect our landlords. We had a close call with a tenant recently when they sent a solicitors letter to start a claim and we were able to fend that off with accurate notes.
A recent case in our management department in Manchester letting agent or a property in Liverpool bought this home to me recently as to why these notes are so important, here is what happened;
A letter was received from a solicitor who had been instructed to act on the behalf of one of our tenants boyfriends (who was not on the tenancy). The letter was outlining an intention to commence legal action against one of our Landlords for injury caused by dangerous property.
The gentleman in question was claiming he had been injured after loose plaster from a kitchen ceiling fell down on top of him during a tenancy. The solicitors letter states the incident happened on the 14th of April and head injuries & soft tissue injuries were obtained as a cause of this incident.
This is a serious complaint and could result in large penalties for the landlord, in damages if the claim was successful.
Our Property Manager checked through our accurate records, which are name and time stamped when created, and it stated:
On the 14/4/12 which was the following day the notes on the letting system stated, that a man claiming to be the tenants boyfriend, had called in to say that he had in fact been under the ceiling when it collapsed and had been injured, and had instructed solicitors to start action to claim compensation. The tenant had called up the Lettings Manager the day previous stating that the ceiling in the property had fallen down and made a mess, however no-one had been injured by the incident in the rental property. This is an example of tenants trying to use the tenants rights to unfortunately take action against their landlords to make money. As the lettings manager had the notes on the system this is evidence to show that the tenants boyfriend could not make any action against the landlord of his false claims. All estate agencies who deal with property to let or buy to let should take serious note on this example.
