She had to be rushed to an emergency room complaining of intense pain seven months after her original visit to her primary care physician. They scheduled a colonoscopy at which time she was diagnosed with advanced colorectal cancer. She underwent surgery (which as a consequence of advanced nature of the cancer required not just taking out a portion of her colon but also of her uterus and a portion of the lower intestines). She then needed chemotherapy. The cancer came back and she died in less than three years. Her husband and minor daughter survived her.

The law firm that handled this case published that the case went to trail and the jury come back with a verdict of $2,500,000. The sum included $350,000 the largest amount allowed for pain and suffering under the law of the State where the doctor practices. The rest of the award was for future lost wages. This lawsuit illustrates what might be the most common medical mistake concerning the delayed diagnosis of colon cancer.


Far too often doctors do not order a colonoscopy or send the patient to a gastroenterologist when a person reports rectal bleeding or blood in the stool. Instead, these physicians merely assume that the blood is caused by hemorrhoids. This is particularly typical when the person is less than fifty years old.

If a matter like that above happens and the patient passes away for the reason that the cancer spread to where it was no longer curable because of the delay in diagnosis the surviving family may be able to bring a case against the physician who caused the delay.
