Federal Firearms License 101 The Hows And Whys Of Becoming An Ffl License Holder

Federal Firearms License (FFL) has been a legal requirement within the United States of America since the Gun Control Act of 1968

. The license gives you, the individual or business, the legal documentation to engage in a business to manufacture or interstate or intrastate sale of firearms and ammunition.

The Federal Firearms License was established to put into practice or rather execute the Federal Firearms Act (FFA) of 1938. The license requires manufacturers and dealers of firearms, who ship or receive firearms and ammunition, interstate or foreign, to have a license. Transferring of firearms or most ammunition to anyone is forbidden unless certain conditions are met. Since Congress passed the Gun Control Act in 1968 the lawful interstate trade of firearms has been limited almost entirely to persons holding an FFL.

There are 3 Special Occupational Tax Classes of licensure and within each tax class are Usage Types in which to apply under. In addition, Collectors of Curio and Relic Firearms is another special type of FFL. To be recognized by the Alcohol, Tobacco and Firearms (ATF) as a C & R firearm, the firearm must fall within one of three categories. Antique guns made before 1898 are generally outside of the federal jurisdiction therefore may be bought or sold across state lines without a FFL. Trying to figure out which class and usage type applies to you or which one best fits your needs, is an overwhelming task and most applicants give up their hopes of getting there FFL somewhere in this bureaucratic quagmire.

Accurate record keeping of a Federal Firearms License is a must. A person or business is expected to maintain an ATF approved bound book, Firearms Transaction Records or use a computerized approved ATF software of firearms sales. Keep in mind the ATF is allowed to inspect or request a copy of your records during a criminal investigation. The sale of two or more hand guns to any person in a given period must be reported to ATF and is an example of how what you dont know could hurt you.

The ATF will approve the application based on a number of criteria to be met in addition to what the applicant must certify. Navigating through the path of federal criteria can be a nightmare and 90% of applicants get turned down.

Sifting through the sources of information and making sure you are getting the correct information from the right source can be risky in this day where anybody can publish online as an expert. You could delve into the depths of bureaucratic publications on the hopes that you have downloaded the most current regs, or you can have confidence in my advise and expertise.
