Avoid buying a water damaged vehicle. Often hurricanes put lives of thousands of people in utter disarray. They lose work, home and of course, their cars. Some cars may have damaged only slightly. But the more severe damage results from being completely submerged in floodwaters where the waters levels may be as deep as tens or twenties of feet. Very critically damaged cars actually get destroyed and are sold as scrap. This will prevent such vehicles from reaching the secondary market.

Estimates of water or flood damaged cars run to hundreds and thousands and in all likelihood some of this flood damaged cars will be sold to unsuspecting buyers. Used cars do not qualify under the Lemon Law statutes of most states, so if you purchase a car that has been damaged by flooding you will have no legal recourse against the manufacturer.

How to make sure you dont buy a flood damaged lemon

Check with Carfax to run a check on the cars vehicle identification number, or VIN to know if the car has been damaged or totaled as a result of flood damage.

Water damage is clearly seen in rust and damaged carpet. If the carpet is replaced you should ask why an old car has new carpet. Other problems such as damage to electronics in the dashboard or damage to the transmission or engine as a result of rising water are not easily noticed. If the floods has salt water the damage will be more extensive.

Check with a qualified mechanic specifically to look for flood damage.

A car title may not show water damage if the title is subjected to wash. A tamper proof universal database of car title information should be created to prevent buyers of used vehicles falling victims to undisclosed and water damaged defects.

Used cars do not qualify under the Lemon Law statutes of most states. If you had purchased flood damaged car you will have no legal recourse against the manufacturer. You may have a legal recourse against the person who sold it to you but you need to demonstrate that he did it in bad faith.
