Florida's Adoption Ban Ends: Gay professionals form stable families


2010 has turned out to be a monumental year for gay rights. With changes to the California Proposition 8 and the ongoing court battle concerning the right of gays and lesbians to legally adopt children, it looks as though our nation is making progress in this long heated debate.

On October 22nd, Florida's 33 year ban on gay adoption was finally lifted when Attorney General Bill McCollum refused to appeal a court decision that ruled Florida's ban on gay adoption as unconstitutional. For more than 33 years, gay parents have been allowed to foster children, but not adopt them. The legislation to overturn the law began when Frank Gill sued the state after being refused the right to adopt two foster children who had been in Gill's care for six years.

Gill was finally allowed to adopt the two children after the court unanimously decided that the law which banned gay adoption in Florida had no ration basis and was overturned by a three-judge state appellate.


Friday, Florida's 33 year ban on gay adoption officially ended after Florida Attorney General Bill McCollum decided not to appeal a recent court ruling that Florida's ban on gay adoption unconstitutional. This is a huge movement forward in gay rights, as the Department of Children & Families in Florida has already begin revising their forms which ask parent's about their sexual orientation in order to determine eligibility for becoming adoptive parents.

When questioned about the court's decision to overturn the ban, Frank Gill seemed relieved. "We are relieved that this process has finally come to an end, and that we can focus on being a family.All children deserve a chance at finding a stable, loving and permanent home. Over the 33 years of the ban, this archaic law has harmed countless foster children by denying them a forever family."

This decision being overturned now means that thousands of gay couples can now legally adopt children within the state of Florida, offering homes and a stable environment where previously they might not have had the chance to have such a stable environment. As more poor decisions like this are overturned, lesbians and gay professionals rights move forward to stand on more equal footing with straight couples. The decision not to appeal the ruling means government officials are finally recognizing that sexual orientation has no place in determining a person's right to marriage or the care of a child.
