Getting Justice for an Unfair Dismissal Case

It's been true with any contract that you may have signed to work for a particular employer that they would have the right to dismiss your services without notice or for any major reason. No one can really do much about this especially if they have agreed to the terms of the contract, but sometimes there are things that can happen to a person that may have worked for a company for a while and then they are dismissed from their work duties for something that was irrational on their behalf. However there are cases that can be filed against an employer to where the ex employee can get some justice for being treated unfairly because of a work situation.

There are some standards that are required if you want to file charges against an act of unfairness from the employer. These standards would include:

- You would need to have been employed at a particular job for at least a year.

- Being terminated without legal rights; termination being forced on you.

- Restricted from going back to your job when the employer had previously given you permission to leave temporarily.

- Not reaching your age of retirement.

You might have gotten an injury or something else personal could have happened to where you were prevented to going back to your current job. Employers will often terminate workers that cannot continue their previous duties, which is usual. However, they are supposed to follow the guidelines of knowing whether or not there is another position that you can take at the company that would not interfere with a personal issue such as an injury or handicap. Failure to seek out other positions for the current employee could result in the employer having charges pressed against them.

If there were no other positions for you to fill at the time then the employer must present documentations to prove that in court. There has to be evidence that you personally signed in agreement. If they fail to offer documents then the employer would be required to find a new position for the employee.

For the most part after being misled and mistreated at a previous job, an employee will often have the option of taking a new position as the company or being compensated differently. Of course this will all be determined according to how long you have been working for the business and how much you were money you were making.

There are many solicitors in London and all over the country who could help with your unfair dismissal case so make sure you explore all your options.
