Girl Sues For Blindness
A girl aged nine is suing her father for 2million compensation after a car crash
he caused while she was still in the womb eventually led her to go blind.
Jamie Cook was born 12 weeks premature after her mother - who is still married to her dad but is helping to sue him - suffered a placental abruption - where the placenta becomes detached from the wall of the womb - in the 2001 smash.
The baby suffered brain haemorrhages and had to have a shunt inserted to drain excess fluid from her brain to her stomach.
But aged three years she fell ill, vomiting repeatedly without bringing anything up - but the toddler's GP allegedly failed to recognise that the shunt had become stuck.
Jamie suffered a seizure the following day and was rushed to hospital with an enlarged pupil, before medics discovered the shunt had stopped working properly.
The writ says: "This caused severe intracranial pressure which resulted in damage to the brain and, in particular, to the optic nerves. As a consequence thereof, the claimant became totally blind."
Jamie and her mum Karen, 36, plan to sue GP Dr Elizabeth Walker and 38-year-old dad David, who was convicted of driving without due care after the crash.
The legal documents claim he "failed to take any adequate care for her safety" and "exposed her to a foreseeable risk".
It also accuses Dr Walker of "falling below the standard of a reasonably competent GP".
If successful she could be entitled to a 2million personal injury payout.
Last night Mrs Cook, of Cholsey, Oxfordshire - who is expecting her fourth child with Jamie's dad - said "That's the way it is, that's all I'm going to say," when asked about her plans to help sue her husband.
Dr Walker refused to comment.
