GlaxoSmithKline Reached Poligrip Lawsuit Settlements in 2010
While upcoming denture cream trials are expected to resolve claims of neurological damage from zinc poisoning against GlaxoSmithKline and Procter & Gamble, it is often overlooked that in 2010 GSK agreed to settle a number of the Poligrip lawsuits it faces.
Reports surfaced in July 2010 that GlaxoSmithKline had reached Poligrip settlements with at least one law firm. Though court documents did not disclose the number of cases settled and the amount they settled for, on July 27 the judge in charge of denture cream multidistrict litigation (MDL) established a qualified settlement fund on behalf of plaintiffs represented by a New York law firm. Glaxo confirmed in both its 2010 second quarter earnings report and its Annual Report 2010that it had agreed in principle to settle the Poligrip lawsuits. In the former, GSK acknowledges on page 26 that, "With respect to the Poligrip product liability litigation, [GSK] has reached agreement in principle to settle the vast majority of cases."
Federal denture cream lawsuits were granted MDL in June 2009, consolidated under Judge Cecilia M. Altonaga in the United States District Court for the Southern District of Florida. Separately, a number of state lawsuits have been centralized into a Mass Tort Program (MTP) in Philadelphia. The lawsuits against GSK and P&G make similar accusations that the manufacturers failed to disclose zinc as a denture cream ingredient and did not provide warning of zinc's health risks.
The dangers of denture cream zinc were first brought to light in 2008 by University of Texas researchers, whose groundbreaking study established a link between zinc, added to dentures to improve bonding, and neurological impairment. Since then hundreds of people reporting symptoms such as pain, weakness, difficulty walking, and numbness in the hands, feet, arms, and legs have filed product liability suits against GSK and P&G seeking financial compensation for the losses resulting from their injuries.
Despite GSK's claims that it has settled the majority of the denture cream lawsuits against it, a court document still names the company as a defendant in upcoming denture cream lawsuits, the first of which is scheduled to begin on June 6. Judge Altonaga has, however, ordered the parties to mediation, which could result in the cases being settled out of court. The deadline for such out-of-court settlement is March 28.
