Grounds for Divorce in Thailand

It is a common knowledge that divorce is legal in Thailand

. But it would not be processed without due reasons.

As stated in Thailand's Family Law, a divorce, whether contested or uncontested, may be filed under the following circumstances:

Adultery is committed by either party, or both.

One party committed gross misconduct not necessarily a criminal offense - which caused the other party too much embarrassment, insults, or injuries, for continuously being the spouse.

One party caused serious physical, mental or emotional harm or torture to the other party or his or her ascendants.

One party has intentionally abandoned the other for a year already, or more.

One party is imprisoned for a year already, and the other party is not involved in the case.

The husband and wife is separated or do not cohabit for three years or more.

One party disappeared for three years or more, whether living or dead.

One party cannot provide proper maintenance and support to his or her family, causing problems to the other party.

One party suffers from psychological incapacity for three years or more, as proven by medical experts, and cohabitation is no longer safe and possible.

One party breaks the bond of good behavior, agreed upon by the couple before the marriage.

One party has a communicable, dangerous, chronic, and incurable disease.

One party is proven incompetent in living a married life.

Although Thai laws are quite lenient to this kind of issue, divorce processesare complex. Thus, in filing a divorce in Thailand, it would be best to seek legal assistance from competent and well-experienced lawyers.
