A new announcement was made by Hilda L.Solis the U.S

. Secretary of Labor regarding the H-2A Program for the temporary agricultural workers of the US. The final rule was published in the 12th edition of the Federal register. The rule speaks about enforcement mechanisms of the H-2A temporary agricultural worker program and also about the labour certification process.

From March 15, 2010 this rule will come into effect. This new rule is applicable for the foreign workers who are either coming to work in U.S or are already working there for seasonal or temporary agricultural works.

The U.S Department of Labor has to certify through its Employment and Training Administration that there are no adequate and qualified U.S workers to perform the labor. It is only then, that the H-2A nonimmigrant visa petition would be approved by the U.S. Department of Homeland Security.

The U.S Department of Homeland Security would try to implement the terms and conditions of the labor certification through its wage and hour division and also protect the workers. The rule enforces better and stronger mechanisms for the protection of the workers under the H-2A program. A better access to the domestic labor market would be benefitted by the workers with the added benefit of increased wages.

The H-2A temporary agricultural worker program also ensures that the workers working under the same employee and in the same occupation be given the same wage as the foreign worker, irrespective of the date of hire. Protection of the workers from work abuse is also a part of the H-2A program.

The new rule for the H-2A nonimmigrant visa is an outcome of the departments review of the policy decisions of previously revised H-2A program that was published in late 2008. Secretary Solis said that the workers problems would definitely be detected and remedial actions would be taken.
