If you follow medical news, you may have heard of the DePuy hip replacement recall, which started in the summer of 2010. Ever since July of 2003, thousands of patients have had hip replacement devices implanted in their bodies. Many of these patients have recovered with no harmful side effects. A minority of patients, however, have reported adverse reactions.

These adverse reactions could be anything from pain, swelling or difficulty in walking to permanent bone damage and metal poisoning. The company voluntarily agreed to remove the product from the market after learning that at least 12 percent of all patients developed adverse reactions to the systems. The company is advising patients to go to their doctors and undergo testing for metal poisoning in the blood as well as the functionality of the implant system. The company DePuy, the recall notwithstanding, is stating that not all products are a health risk. They state that only a small population is reporting unhealthy side effects from the hip replacement systems.

In addition to removing the faulty systems from the market, the DePuy company is also offering financial compensation to patients implanted with these questionable devices. They claim that patients, if implanted with faulty devices, can call their ASR help line and request claimant information. How is the company handling the DePuy recall?

The company has earned some respect from the community for owning up to its mistake, and withdrawing their products before the FDA banned them. They have also pleased some patients, by paying for their surgeries and diagnoses. However, some attorneys believe the company's actions are "too little, too late" in terms of fairness. First, clearly not every claimant is receiving the compensation they want, since the company has said that it will only pay "reasonable" costs for medical expenses and pain. Many patients are reporting more extreme discomfort than the company is indicating in their well-worded corporate message.

Another problem that has been occurring in recent months is that of claims adjusters who may not be paying for all related expenses. The DePuy company requires patients to first submit their claims through the insurance company. Unfortunately for patients, claims adjusters are notorious for talking patients out of all their claims. Some reports indicate that claims adjusters are using aggressive tactics in order to catch the patient off guard and dismiss the claims. This is problematic, because patients should only be dealing with medical professionals trained to discuss medical issues.

Other attorneys are claiming that DePuy's guidelines are narrow, and seem to match that of insurance claims adjusters which of course, are never in the "interest of fairness." Why, some patients are even complaining of unreturned phone calls. Despite DePuy's willingness to make amends publicly, not all patients are convinced that they are privately owning up to their mistake.
