But not every graduate of law school comes out equal. As in every profession, there is quite the gap between the best and the worst. When looking for someone to represent you, there are some questions you can ask to make sure that you don't pick from the latter category.

How do you do your billing?

It's important to get this question out of the way before you begin getting serious about hiring an attorney. Some lawyers work on a contingency basis, meaning they take their fee out of the settlement. This is commonly seen in civil trial lawyers or those specializing in personal injury cases. In other areas of the law, you're probably going to see one of two billing methods. Those firms that bill a flat rate and those that bill by the hour. If you're unsure about your budget, you might want to look into a flat rate billing firm. If you'd rather not pay for work your lawyer isn't doing, an hourly rate might work better for you.

Is my case common?

You want to find out early on if the attorney you're thinking of hiring has a lot of experience. But just being in practice for several years doesn't mean they have handled cases like yours. While it may be exciting for the lawyer to come across a case that represents a challenge, it's not particularly good news for you. Unless you have a really exceptional situation, you want a lawyer who has handled plenty of cases of a similar stripe. The more time he spends fumbling around and researching the legal precedent for cases like yours, the less time will be spent actively moving forward towards a successful conclusion. Why reinvent the wheel if there is a lawyer across town who knows the ropes?

Are we on the same page?

Chances are, you went into your search with a case conclusion in mind. Maybe you're suing for personal injury reasons, in which case you may have a settlement figure in mind. Perhaps you are looking for a divorce and you know just what you want (or want to keep) from your spouse. Whatever the situation, you should make sure that the attorney you hire is on the same page.
