Q. My neighbour has mounted a Closed-circuit television camera which is directed in the direction of my house / back garden. Is this a breach of the Data Protection Act?
A. If your neighbour's surveillance camera is installed on their residential property and being used for their own individual household use, they are not likely to be breaking the Data Protection Act. This is because the use of Cctv cameras for household protection purposes is exempt from the data protection principles. This applies when a person uses Cctv to safeguard their property from robbery, even if the camera overlooks the road or other areas near their home .
