How To File Consumer Complaints

The Consumer court is the best chance to get your voice heard and get you an appropriate

compensation in case any service or product provided has not delivered what was promised.

In order to file a complaint in consumer court; you would need evidence, you should have all the supporting documentation like: invoice or bill for purchase, warranty card, proof of payment i.e. copy of cheque or credit card statement, any communication records like e-mails etc.

Next step is to officially notify the Company of your grievance, explain the matter in detail & what you expect from the Company. Your notice should be printed in English, signed by you and sent by registered post at the registered office of the company. The Company should be given a reasonable time to resolve the matter, if no sufficient reply is received from the Company then the aggrieved person to file the petition before the Consumer Disputes Redressal Commission.

Salient features of Consumer Protection Act, 1986


The act came into effect on December 24, 1986. The act is applicable in all states in India except inJammu and Kashmir. The act makes provisions to include both tangible goods and intangible services purchased from a trader or service provider. The act can apply to any consumer who uses the product for non-commercial activities; the act excludes commercial customers, but includes individual domestic customers, groups of domestic customers, societies and not-for-profit organizations.

Amount of Compensation You Seek from Consumer Disputes Redressal Agencies

District Consumer Disputes Redressal Forum

Up to Rs. 20 Lakh

State Consumer Disputes Redressal Commission

20 lac to 1 crore

National Consumer Disputes Redressal Commission

Higher than Rs. 1 Crore

Manner in which complaint shall be made:

1.The complain to be made by the consumer to whom such goods are sold or delivered or agreed to be sold or delivered or such service provided or agreed to be provided.

2.The complain can be made by any recognised consumer association whether the consumer to whom the goods sold or delivered or agreed to be sold or delivered or service provided or agreed to be provided is a member of such association or not.

3.The complain can be made by one or more consumers, where there are numerous consumers having the same interest, on behalf of, or for the benefit of, all consumers so interested.

4.The complain can also be filled by Central Government or the State Government, as the case may be, either in its individual capacity or as a representative of interests of the consumers in general.

5.Every complaint filed shall be accompanied with such amount of fee and payable in such manner as may be prescribed.

6.Every complaint shall be decided within twenty-one days.

7. The Forum shall after giving a reasonable opportunity of being heard to the complainant as well as the opposite party, issue an appropriate order.

Appeal

Any person aggrieved by the order of District Forum may prefer an appeal to State Commission within 30 days,


Any person aggrieved by order of State commission may prefer an appeal to National Commission within 30 days, and

Any person aggrieved by the order of National Commission may prefer an appeal toSupreme Court within 30 days.
