How to Fight Back When Slapped with an Ex Parte Restraining Order
If you are one of those father's reeling with the emotional shock of not only being
falsely accused of something horrible but hit with a restraining order your first reaction may be to lash out or even give in. If it is the first keep in mind, anger never solved anything. If your reaction is the second then know in the long run you won't help your kids by caving. Here are some things you can do to fight back and do it the right way.
Keep in mind there is a Procedural Due Process that is required for everything that is done. Many times this is totally ignored. Make sure you and your lawyers are on the ball and it is followed each and every time.
Arm yourself with knowledge. YOU need to know what needs to be done. Don't just rely on your lawyers or what others tell you.
Get a transcript of the hearings. Many times an Ex Parte Restraining Order is issued without you or your legal representation being present. That means you only have hearsay to go on. Don't except what someone else says took place. Know for sure by demanding transcripts.
Understand that you can appeal the process. It is part of your legal rights to be able to appeal and present your side of the story. Remember, everything you hold dear -from your kids to your reputation is on the line. You must never be willing to give those up without a battle!
Don't panic. Know your rights, fight back and stay calm. It may be a long battle but it is one that is worth it.
