Corporal Punishment on wives in Islam
The Holy Quran lays the greatest possible stress on kindly and good treatment towards the wife.
Quotes from Sura Four of the Quran
Verse 19: O ye who believe! Ye are forbidden to inherit women against their will. Nor should ye treat them with harshness, that ye may take away part of the dower ye have given them,-except where they have been
guilty of open lewdness; on the contrary live with them on a footing of kindness and equity. If ye take a dislike to them it may be that ye dislike a thing, and God brings about through it a great deal of good.
(The above verse insists on kindness even when a man dislikes his wife, because God says you may dislike a thing in which there is abundant good)
Verse 20: But if ye decide to take one wife in place of another, even if ye had given the latter a whole treasure for dower, take not the least bit of it back: Would ye take it by slander and manifest wrong?
The Holy Prophet laid equally great stress upon good treatment of his wife.
To quote him,
"The most excellent of you is who is best in treatment of his wife" Ref: Muslim 13:11
Again he said," Accept my advice in the matter of doing good to women" Ref: Bukhari 67:81.
In the Holy Prophet's (PUH) famous address at the Farewell Pilgrimage (Hajjul Wida)
he said "O my people! You have certain rights over your wives. And SO HAVE YOUR WIVES OVER YOU. They are trust of God in your hands. You must treat them with all kindness."
On another occasion he said "The woman is like a rib, if you try to straighten it, you will break it" Bukhari 67:80
However in case of her openly immoral conduct, the husband can either divorce her or punish her, this is where the corporal punishment comes because Islam places the highest value on the chastity of women..
Also in the following cases (1) revolting against her husband such as resisting, hating, deserting, sharing her bed with others etc, the remedy suggested is (1) simple admonition on her and leaving her alone on her bed (to allow sincere repentance)
But if a wife goes beyond that, deserts the husband and her conduct becomes suspicious, as a last measure, the husband is allowed to inflict slight corporal punishment WHICH MAY NOT LEAVE ANY EFFECT ON THEIR BODIES
It can not be denied that cases do happen when this extreme step becomes necessary. These are exceptional cases and their occurrence is limited to the rougher strata of society where the slight corporal punishment is not unobjectionable, may be even desirable to save the
marriage,to avoid divorce and to correct mistakes. Such conduct or such treatment on the part of the husband may not be expected in any good family.
