Consider what took place in a reported lawsuit involving a woman who told her family doctor that she saw blood in her stool and felt pain during bowel movements. She was just 24 years old. The physician, justwithout even conducting an examination, told her to take a laxative after diagnosing her with diarrhea and other bowel issues. The woman returned four months later with complaints of constipation, pain and problems sitting. Now the doctor finally examined her and assured her she had hemorrhoids. The physician recommended an enema. She went back to the doctor 2 more times and every time was reassured that her symptoms were due to hemorrhoids and she had nothing to worry about.

The woman had to be hurried to an emergency room complaining of intense pain 7 months following her original trip to her primary care physician. They scheduled a colonoscopy and was found to have advanced colorectal cancer. The cancer was so extensive by the time she underwent surgery that not only did the surgeon have to take out part of her colon but also had to remove her uterus and a section of her lower intestines. The surgery was later followed by chemotherapy. She ultimately had a recurrence and passed away from the cancer not even 3 years after. She was survived by her husband and daughter, a minor.

The law firm that represented the family reported that a jury returned a verdict of $2.5 million. The sum included the maximum of $350,000 permitted for pain and suffering by the law of the State where the physician practices. The remainder of the amount was for future lost wages. This lawsuit is just one example of what is perhaps the most frequent medical mistake concerning a delay in the diagnosis of colon cancer.


Too often doctors do not do a colonoscopy or send the patient to a specialist when a person complains of rectal bleeding or blood in the stool. Rather, these physicians just assume that the symptom is caused by hemorrhoids. This is particularly common when the patient is under 50.

If a situation such as the one described above occurs and the patient passes away due to the fact the cancer spread so far that a cure was no longer possible as a consequence of the delay in diagnosis the surviving family might be able to bring a claim against the physician responsible for the delay.
