If you are the cause of an accident, you may feel really bad about it. However, in some cases you may be seen as responsible for the injury due to negligence according to the law.
There are several things that you should know in case the law decides that you are legally responsible to cover the damages. The first thing you will want to know is that most negligence lawsuits are only civil lawsuits.
Under the civil law you will not face criminal charges for your negligence. Only the occasional case of extreme negligence will be considered for criminal court.
If this happens, then a different case has to be brought and you will be forewarned. In these cases, you may face criminal charges.
However, this is usually in a case where you behave so recklessly it could have ended in nothing but people getting hurt. Vehicular manslaughter is the most common form of negligence that faces criminal charges, particularly if you were drunk or distracting yourself in some way.
The second thing you should know is that there are many form of negligence. You are responsible for yourself and your actions.
This means that you need to be careful to avoid injuring others at all times. Some examples of negligence include driving carelessly, inviting someone over when your home is in a dangerous condition, or letting the dog you know tends to bite off of his leash.
However, in most cases you will be judged according to how a reasonable person would have acted in the same situation. If the reasonable person would have been more careful, you will probably be found guilty.
However, if the reasonable person would have acted the same or in a similar manner in the same situation you may not be found guilty. It is also good for you to know that the rules regarding negligence may be slightly different if someone is injured at your home or business.
The rules are set based of different types of visitors and different levels of duty. For example, the case will be different whether you are inviting a friend to your home or whether you are inviting a customer to your home to do business.
It will also be different if you are considered to be professional business and someone enters the store and is hurt. The customers that enter the store are considered to be invited there even if you had never talked to them before.
As they are invited there, it is your responsibility to provide for their needs and protect their safety. If someone comes to your home for non-business related purposes they are a licensee and you do not have as much responsibility to care for him or her.
Do not be mistaken, you still have to be somewhat concerned and protective of their safety. You simply do not have such a high responsibility as if it was business related.
It is also important for you to know that negligence is not the only thing that you can be sued for. If you intentionally injure someone, you will also be required to pay a reimbursement.
In addition to paying for the actual medical bills related to the injury, you may also have to pay for legal damages. In a typical personal injury lawsuit, you will be sued for money to cover medical bills, lost wages, and emotional stress and pain.
If you have to pay legal damages as well, you will have to pay for his or her lawyer. The expenses can really add up quickly for negligence.
However, on the bright side, most personal injury cases are settled out of court. In most cases, you or your insurance will settle with the plaintiff on an appropriate amount before it goes to court.
Few people want to go to court. They would much rather simply get some money for their pains and leave.
This also allows you to have a say in how much you pay instead of leaving it up to the jury to decide. It is to your advantage to settle out of court if you can.
There are many things to consider when you have accidentally hurt someone. Make sure that you get the help you need from a lawyer if you are sued for your negligent action so that you will avoid going to court and paying more than you have to.
