Some states have felt that this was an injustice and have passed statutes directing that where the legatee or beneficiary was a descendant, brother, or sister of the testator, his death prior to the death of the testator will not result in the lapse of the legacy if the descendant, brother or sister shall be survived by a child or other descendant. You should confer with your own lawyer as to the applicability of such a statute in your state.
