So far, there are twenty two states that have filed legal lawsuits against the health care reform It will have to go through a lot of legal documents before a legal decision about it can be made. There are several main issues to contend with and a few of the twenty-two states have combined their efforts.
1. The problem of requiring citizens to get medical coverage
2.Implementing a fine for those who won't purchase the mandated health care
3.Against the state's sovereignty as stated in the Commerce Clause
4.Unjust burden on the states' finances
The health care reform bill is now a law. The challenge is to convince the judges that it is partially constitutional. But the new health care law seems like it is violating the states' rights as stated in the commerce clause. Unless Congress wishes to change the wording of commerce clause, this health care bill will need to eliminate a few of the major issues.
However if they really want to push through with the overhaul, they need to modify how it is worded and show a fair cause that it's merely a means for taxing Americans all across states. Or they need to convince the people that this is good for everyone or the majority of Americans.
Currently there are a lot of individuals who are enraged at the contents of the new law because they know that this is just another means for the government to get more money from the people. In many ways, we the people are reaching the saturation point where it is no longer profitable to hold down employment.
Will the new law become successful when more and more people lose their homes and unemployment rates keep on increasing? Will it survive even when more businesses are affected or their businesses are moved elsewhere? What will happen when even more citizens move out of the country as many have already done?
The current legal challenges being placed and argued in the courts will take time to find their way through the system. Meanwhile insurance providers are starting to prepare to accommodate the millions more citizens who will be seeking health care as per the new mandate. But they should analyze the situation first before they count their expected profit.
