Licensing Your Work

As a creative artist, you want to be in control of your intellectual property. If you have any interest in commercializing your work, you may assume that the only way to make money is to sign away your rights -- but this is not the case. In fact, by licensing your work, you get the best of both worlds: you get to keep the rights to your own work, and you get to control not only who uses your work, but how they use it.

While it may not be immediately clear why it would be important to control how someone uses your intellectual property, it's an important point worth considering before licensing your work (or signing it away entirely). Consider the following: you're an artist, and you've created a collection of paintings that, as a whole, represent something complex. The meaning you intend is only conveyed through the collection as a whole. If you license your work to someone, you would have the ability to stipulate that your work is displayed as a collection and that no piece can be taken out of context and displayed on its own, ensuring that your original message is not corrupted or compromised.

For a less abstract example, consider the following: You're a dedicated up-and-coming playwright, and you've written a fantastic script perfect for the stage. You sell the rights to someone, who takes great liberties with your script and turns it into an after-school bubblegum dramatic miniseries. Will you be able to pursue a career in your chosen genre, or will those in your industry fail to take you seriously? Typecasting is a powerful force.

The only way for you to retain the control and thus protect the integrity of your intellectual property is licensing your work while retaining the rights to it yourself. If you're serious about your creative works, it's not enough to decide who gets to use it. You need to have the final say over how your intellectual property is presented to the world.
