The Licensing Act 2003 saw the introduction of a single integrated system in England and Wales to regulate the sale and supply of alcohol, the provision of entertainment to the public and the provision of late night refreshment. The principles of the licensing law in England and Wales are covered under four licensing objectives: The Prevention of Crime and Disorder, Public Safety, The Prevention of Public Nuisance and The Protection of Children from Harm.

Under this Act any sale of alcohol must be made or authorised by a personal licence holder who must hold a relevant accredited qualification, know as the NCPLH or Level 2 Award for Personal License Holders QCF.

The Licensing (Scotland) Act 2005 sets out the legislation and law relating to the sale of alcohol in Scotland. The Scottish Government concluded that this legislation would be steered by five core objectives: Preventing Crime and Disorder, Securing Public Safety, Preventing Public Nuisance, Protecting Children from Harm and Protecting and Improving Public Health.

A manager in the licensed trade in Scotland is required to understand these objectives and be fully aware of their legal and social responsibilities in the supply and dispense of alcohol. The qualification required in Scotland for both on and off sales premises, is known as the SCPLH or Scottish Certificate for Personal Licence Holders.

In order to acquire an SCPLH, it is necessary to undertake a personal license course and exam, in order to attain the Personal License Holder Qualification issued by the SQA.

The Licensing (Scotland) Act 2005 also states that all staff who wish to sell or serve alcohol in licensed premises must have received at least 2 hours of training to ensure they are fully aware of their responsibilities in serving alcohol, and understand licensing law and responsible serving practices. The Scottish Executive have detailed 16 points that the staff licensing training must cover.

In England staff licensing is not a legal requirement under the Licensing Act 2003, but it is promoted as best practice within the industry.
