Locating A Judgment Debtor To Recover A Judgment
Locating the judgment debtor, is the first step to serve them notice of your lawsuit
, and later to try to collect your judgment against them. No one else can satisfy your judgment. If you learn where the judgment debtor, lives, that's usually the first step toward finding their available assets, which could ultimately lead to collecting your judgment. When your debtor, got served at their residence or work, that's the first place to look for the debtor. If your judgment is not recent, the debtor, might not work or live there now, yet those are the best places to begin.
Some debtors, try to hide from judgmentcreditors. Often, judgment creditors can still find them. Start with what you know, and investigate further. For example, you might already know of an address which the judgment debtor used to be at. You might be able to contact people who most likely know something about your debtor.
If you talk to the debtor's, former or current neighbors, family, roommates, or co-workers; don't come across in ways that might make them suspicious. Especially with the judgment debtor's, immediate family, attempt not to arouse their suspicions, about if they should talk to you, a stranger, about their family member.
The usual way to get free and informal information from people who know your debtor, is to lie a little. An example lie could be "I'm a long time friend of Dan Debtor from... and I want to catch up with him, do you know where he moved to, or how I can contact him" Never tell lies to locate a judgment debtor's banking information, but it is usually OK to find out where they moved to, their email address or telephone number, or where they work.
People might blab away about someone they know, and some will even blab about people they do not know. Listen attentively, to decide whether there are any negative feelings about the debtor. When they have bad feelings, they may tell you better info. Listen attentively, and politely ask investigative questions.
If you are trying to discover out where a person (e.g., your debtor) lives now, you are skip tracing them. A skip is the person you are trying to locate. Don't attempt to act like a private investigator or bill collector, or even tell them that you own a judgment against the debtor. Often, the best source of info about a judgment debtor, is their ex-spouse or their former girl or boy friend. The next best is the debtor's, friends or co-workers. Contact one or more of them, and maybe you can find a sympathetic ear. One of them might give you some valuable info.
At the same courthouse where you got your judgment, there might be other judgments against the debtor. Finding and contacting other judgment creditors could be helpful. They may be glad to trade information. Sometimes other judgment creditors will not want to disclose any information, because the first judgment owner to figure out where the debtor works or banks, gets to hire the Sheriff to garnish the judgment debtor's, assets. The first to get paid usually is the winner.
