Mining Regulation We Should Bear In Mind
The Mineral Resources Law of the People"s Republic of China
, which was first passed at the 15th Session of the Standing Committee of the 6th National People"s Congress on 19 March, 1986 and was amended at the 21st Session of the Standing Committee of the 8th National People"s Congress on 29 August, 1996, is the general law on the exploration, development and utilization of mineral resources in China and is the legal basis for leading, organi-zing and administering the exploration, development and protection of mineral resources. As stipulated by the Law, the department in charge of geology and mineral resources shall adopt a unified registration system for mineral resources exploration. A competent authority for the registration shall, in accordance with the Provisional Regulations for the Administration of Registering Mineral Resources Exploration promulgated by the State Council on 29 April, 1987, examine the scope and contents of the exploration project applied for by any unit. If the project applied for satisfies the requirements, a licence for the exploration, i.e., the exploration right, shall be granted. The Law also prescribes that the State shall adopt a system of examination, approval and licensing for the mining of mineral resources. According to the Provisional Regulations for the Administration of Registering Mineral Resources Exploitation by State-owned Mi-ning Enterprises issued by the State Council on 29 April, 1987, the department in charge of geology and mineral resources under the State Council shall go through mining registration procedures for and issue mining licences to all the mining enterprises approved by the in-charge department of the State Council and established across provinces, autonomous regions, or municipalities directly under the Central Government. The State shall implement the policy of protective mining of gold, wolfram, tin, antimony and ion-type rare earth deposits. The State Council issued on 30 October, 1988 the State Council"s Notice about the Implementation of Protective Mining of Gold Mineral Resources and released on 15 January, 1991 the State Council"s Notice about Classifying Wolfram, Antimony and Ion-type Rare Earths as the State"s Special Mineral Varieties to Be Mined in a Protective Way. The State shall adopt the system that mineral resources are to be used with compensation. Resources tax shall be levied by the State Taxation Authority in compliance with the Provisional Regulations for Resources Tax of the People"s Republic of China promulgated under No. 139 Order of the State Council on 25 December, 1993, and shall be included in the State"s revenue. In addition, to ensure and promote the exploration of mineral resources, mineral resource compensation shall also be paid in accordance with the Provisions for the Administration of the Collection of the Mineral Resources Compensation promulgated under No. 150 Order of the State Council on 27 February, 1994 and shall be brought into the State"s budget, specially administered, and be used mainly for mineral resources exploration. To strengthen management of the funds for geological prospecting of gold deposits, on 5 November, 1994, the Ministry of Metallurgical Industry issued, with approval from the State Council on 29 September, 1994, the Interim Regulations for the Administration of the Funds for Geological Prospecting of Gold Deposits. In 1993, the Chinese government readjusted the policy of gold industry: allowing fo-reign entrepreneurs to participate in the development of low-grade gold ores that are difficult to dress and smelt. On 24 June, 1994, the State Council"s Reply to the Issue of Using Foreign Funds to Mine Gold Resources Low in Grade and Difficult to Dress and Smelt was released.
