No Win No Fee What Can I Claim For
Many men and women have an incident and question if they can claim personal injury compensation for the injury or trauma that they have endured
. A great number of claims are very clear cut when it comes to personal injury as for example road traffic accidents and accidents caused by other individuals. This is generally because there is a clear place to point the blame.
However some personal injury compensation claims are not so straight forward or so it may seem to an individual who does not completely grasp the system. All personal injury compensation claims vary in the way that they are all specific in terms of the way that they have happened. But there is a common element with all accidents and that element is there is another person who caused the accident, the individual could be you or it could be the negligence of another individual or company.
Have a peak at the claims below, both of them are real lawsuits but for legitimate grounds the personal elements have been excluded.
Case 1
Mr x was making use of an alloy ladder to gain access a roof where he was carrying out work, when climbing the ladder the system that locks the step ladder and stops the product form closing failed. The ladder closed while Mr X was still climbing the aluminum ladder and he fell from almost 2 meters in height. Mr X broke his leg as a result of the accident and was not capable to work for some time. The case was taken to court to fight for damages for the injury that Mr X had received. It was unearthed in the court hearing that Mr X had been making use of the alloy ladder to access a building whilst carrying an amount of building blocks. The joint weight of Mr X and the house bricks did in fact exceed the safe working weight limit of the ladder. The judge ruled that the claim was one of abuse of the unit and no compensation was awarded to Mr X
Case 2
Mrs Y was using an aluminum ladder to access a loft opening and when she was ascending the alloy ladder a similar thing happened. The locking mechanism that prevents the ladder from collapsing broke and the aluminum ladder collapsed whilst Mrs Y was still on it. This case is nearly identical to the instance above but when explored properly it was found that there was a production defect with the aluminum ladder. The company who manufactured and distributed the ladder was ordered to pay Mrs Y for her discomfort.
The point I am trying to make here is that there is always somebody accountable, but that person could possibly be you. It is stupid to try and claim compensation for an incident that is your fault as you will not stand a chance of winning the case. Lots of no win no fee law firms will not take on a claim that is not clear cut or they know that there is no opportunity of winning. If you think that you are entitled to damages for whatever reason then it is suggested that you talk with a personal injury solicitor to see if you have a good case.
