De nieuwe wet wordt waarschijnlijk gelijktijdig ingevoerd met de nieuwe Wet Personenvennootschappen

. Deze wet ziet onder meer op de verdwijning van de maatschap en de vennootschap onder firma; in de plaats daarvoor komen de openbare vennootschap en de openbare vennootschap met rechtspersoonlijkheid terug. De inwerkingtreding van beide wetten staat nog steeds gepland voor 1 januari 2009.
