Out of Court Custody Settlements

While most custody battles take place in the courtroom

, there are many situations where the issue has been handled out of court. Often times though, fathers do not even know that the situation can be handled that way.

Thinking of the Kids

If mom and dad are willing to work together for the children's sake, then things can often be handled outside of the courtroom. This can be a good option for the dad since the court's usually always take the side of mom. But be sure you know what you are getting in if you decide to go the route of mediation.

Get It In Writing

No matter what your ex-wife agrees to verbally, never go with just her word on it. Get it in writing, always. She may say anything to keep you happy, but being willing to put it on paper is another thing entirely. This is when she may decide to back pedal and change her mind.

Deal with Important Things First

Whenever you are dealing with mediation of this sort, there is a list that will be covered. Often times the smaller, less important things are put at the top hoping to distract the father from the other things. Thus when the mother has "given in" on a large number of small things, she can dig her heels and try to make the larger things be the way she wants them to be. Or she will flat out disagree to what is important to the dad. So make sure the important things are covered first.

Get Help

Don't try to go through a custody mediation process all by yourself. You need help to deal with the legal process and to make sure your rights are protected. See if there is a Father's Advocacy group in your area that can help.

When you settle out of court it can be less dramatic for the children, plus save time and money for everyone involved.
