People Are Filing Hip Implant Lawsuits Against DePuy All Over the Country


Those considering filing a lawsuit against DePuy for its defective hip implant devices are not alone. Already, dozens of recipients are filing lawsuits against the Johnson & Johnson company.

The Star Advertiser reported on one of the most recent people to file a hip implant lawsuit against DePuy, Jacqueline Lum of Hawaii. She is only 51 years old, and had a hip implant procedure done in August of 2009 for her left hip. Three months later, she was already feeling pain. She said:

It's really bad. I can stand up, sit up on a chair, [but] it hurts. [To] sleep at night I need to take medications to help take the pain away.


One lawsuit filed in Chicago includes 13 recipients from Illinois and Indiana. All of them required "revision" procedures to remove and replace DePuy's defective hip implant. On October 6, 2010, Virgil Lewis filed a lawsuit against DePuy in a New Orleans federal court. The Louisiana Record states, "He experienced pain and extreme weakness in his hip and quadriceps despite ideal conditions for the hip replacement."

In California, one hip implant recipient filed a lawsuit against DePuy in the Northern District of California Federal District Court 17 months before DePuy recalled the defective hip implants in August 2010. This was the first DePuy hip implant lawsuit in the nation.

At least two class action lawsuits have been filed. One is in Kentucky, on behalf of recipient Brian Boone. The second is in an Ohio federal court, represented by Carolyn Pearcy who has a ASR XL Acetabular Hip System. She has not had it removed yet but seeks court supervised medical monitoring paid by DePuy.

Two, likely more, persons filed hip implant lawsuits against DePuy. Annie O'Neill of Gardiner, NY, was an active hiker before she received a DePuy hip implant in May of 2009. The hip implant detached from her acetabulum, causing so much pain that she needed a revision surgery in July of 2010. Rocco Rossetti, of Nassau County, filed his lawsuit in federal court in the Eastern District of New York. He felt pain after his January 2010 hip implant procedure, mere months before DePuy's recall.
