Property Investor Partnership Disputes
What is a property investor partnership dispute
?
Property investment is a lucrative investment opportunity to engage in when it all goes to plan. However if you are unfortunate enough to hit a problem and have a business dispute with your property investment partner(s) it is a nightmare. In such an investment you may be half way through developing a property, have tenants in properties you own, and there will be many complexities of your mutual finances in assets for these reasons.
Property investor disputes can come in a range of guises just as can other business disputes. For example:
- Investment disputes: You and your business partner may be in the throes of an irresolvable disagreement regarding the investment of your company's finances, be this is more property or in stocks and shares.
-Tenant complaints: Your tenant's may be complaining about yourself or your partner. A dispute regarding responsibility can usually be easily resolved.
-Landlord Responsibility disputes: Is your partner failing to fulfil their requirements as stipulated in your partnership agreement? Do you feel that the situation needs outside help?
-Development disputes: Perhaps you and your partner do not see eye to eye regarding finances in relation to the development of property you mutually own.
How can this kind of partnership dispute be solved?
1. Mediation
Mediation is the least aggressive way to solve a dispute, it will mean your partnership has the most likelihood of being rectified and prevent irrevocable damage to your business relationship. Your dispute will be settled by a independent third party you will mediate your discussion to make sure both parties get a chance to give their side of the story.
2. Arbitration
This method of intervention is a popular alternative to the courts. A chartered arbitrator will examine your dispute and will give confidential and impartial advice as to the best route of action to resolve the dispute.
3. Court Action
This is the last port of call and in general will only be used in a worst case scenario. This may be used when there are serious financial disputes between you and your partner, in the case that you wish to resolve the partnership, if there are disputes regarding an unclear partnership or in the case that you wish to remove a partner, amongst other issues.
In the case of a property investor partnership dispute you may be well advised to seek legal advice before it escalates.
