A judge may not have the right to overturn a verdict. However, he/she may be able to issue a verdict not withstanding judgment once it has been passed. A verdict may be overturned only if the defendant files an appeal in the court. The notice of the appeal must be filed within a period of 10 days after the verdict has been passed. The defendant may also file an appeal with the appeals court within a period of 30 days. The appellate court may review the case and decide whether to overturn the verdict or not.
Does a person who has been found guilty in a case have the right to file a motion to set aside a verdict?
A person found guilty in a case may have the right to file a motion to set aside a verdict. In most situations, the jury may not be overruled by the judge. Hence, it can be difficult to file such a motion. Such a motion may work in cases of damages or sentencing. For instance, if a person sues a coffee seller when he/she spills hot coffee on himself/herself for not having any warning about how hot the coffee was. In such a case, if the jury awards the person $5 million as damages, the judge may overrule the verdict.
The person found guilty may also have the right to file a motion for a new trial if he/she thinks that he/she was not represented properly by the attorney. If the person is able to prove that the attorney was inefficient and caused the person to lose the case, he/she may be successful in appealing for a new trial.
A person appeals a guilty verdict in a district magistrates court in Pennsylvania. His/her appeal is submitted after the 30 day period when he/she is permitted to appeal the verdict. The district attorney is trying to invalidate the appeal due to the late submission. Can the person do anything in this situation to fight the appeal?
If a person wants to continue with his/her appeal in a situation like the one mentioned above, he/she will have to show a strong reason for submitting the appeal late. If there is a genuine reason, the person may respond to the motion to quash the appeal by the judge stating that he/she had a genuine reason to appeal so late. The persons attorney may respond to this motion. He/she may find an attorney from the Pennsylvania State Bar Association.
What would be considered the best time to file an erroneous verdict complaint or a civil rights action suit? Is it possible to file both at the same time?
There is no thing as a complaint for an erroneous verdict. Hence, the person may have to file an appeal for the same. The first thing a person should do if he/she does not agree with a judgment is to file an appeal with the appeals court to take a look at the case. The
appellate court can go over the case and decide if there were errors in the judgment or not. The court may decide whether the judgment should be overturned or sent to a lower court for hearing.
A civil rights violation, however, is a different case. The person can file a civil rights violation suit if there was a violation of the persons constitutional rights besides the wrong verdict.
