Sexual Harassment And You

The act of sexual harassment is a form of discrimination that is gender-biased and violates the Title VII of the Civil Rights Act of 1964

. This describes that harassment can go into two different categories; quid pro quo (or a resulting equal exchange for both parties) and the other being a hostile work environment.

Quid pro quo sexual harassment is where an individual person (usually the boss or another position that holds authority over another employee) employs sexual favors or any activity of a sexual nature to the victim who is usually of a lower position. Usually the favor consists of the employee losing more than what he or she is bargaining for.

Hostile work environments are far worse than quid pro quo. The employee is subjected to violent and discriminatory conditions based upon his or her gender, with the work conditions enough to cause severe physical and mental damage to the victim. Physical violence, mental trauma, social withdrawal and similar conditions happen due to sexual harassment of this nature. A person's worth can also be undermined because of their gender. Off color, sexual jokes are usually spread and lewd pictures of the victim are some of the harassment done by harassers to their victims.

The law only works if the victim himself or herself takes initiative and brings the case to light. There have been a lot of cases in the past when victims did not take the case to court and had delayed it for far too long, making the case null. Victims should report sexual harassment as soon as possible to the authorities. Especially if the management is unaware of this, or if the management itself is the source of harassment.

In a quid pro quo case, a victim should never accept any form of compensation or payment for a sexual favor. If you agree to the conditions, it could undermine your character and the worth of the case as well. As much as possible, resist all possible benefits you might get and report your case at once to your attorney or lawyer.
