States Expunging Records To Aid Employment

The State of Florida is in the forefront of helping its citizens gain employment in a most perplexing way

. The State of Florida has actively expunged nearly 14,000 cases, up nearly 51 percent over the previous year. With the states unemployment over 11% the talent pool is at high-tide and thus employers can be very selective.

Individuals must have a certificate of eligibility from the Florida Department of Law Enforcement (FDLE) to start the process. Unfortunately the backlog is about 6 months on the turnaround time. Once the individual receives the certificate they can then begin the process of petitioning the court to have their records sealed or expunged.

Some attorneys in Florida have setup their own cottage industry in assisting applicants in having their criminal records sealed or expunged. On average it appears that these types of cases start around $500 and go up from there depending on the complexity of the applicants criminal history.

As a veteran corporate investigator it just seems odd to allow an individual to seal or expunge their criminal history if they have the money and/or because they lack employment. Misdemeanor convictions typically can be sealed or expunged in virtually every state. Here in California, Mel Gibson got his DUI expunged, because it was a first offense and he successfully completed his probation, but then again he is not looking for a job.


As a Consumer Reporting Agency (CRA), any legitimate background check company will adhere to the Fair Credit Reporting Act (FCRA) and start by looking at convictions only, the date of the conviction and whether the offense is germane to the position the applicant is seeking.

A CRA has a dutiful obligation to the FCRA and must protect the civil rights of the applicant while protecting their client.

Granted, people make mistakes in life. What is really important is to see if they keep making the same mistakes over and over. By sealing and expunging cases, it makes it harder to connect the dots and render qualitative analysis to the employer.
