A person commits the offense if the person operates an open-bed truck or an open
flatbed truck or trailer and allows a child younger than 18 to occupy the bed of the truck or the trailer. Truck beds are for hauling, not transporting people, therefore, they don't have the necessary safety equipment to keep people safe while the truck is moving. There are several exceptions, like: if the vehicle is in a parade or emergency, if the vehicle is used to transport farmworkers, or if the truck is the only vehicle owned and operated by members of the household. Fines for this are from $25-$200. Although the statute focuses more on the safety of children, it is highly recommended that truck beds are not to be used for anything other than transporting cargo.
