The Castle Doctrine-how It Affects All Homeowners

I am sure you have heard the saying "a man's home is his castle"

. The castle doctrine is named after that thought and even the old Clint Eastwood movie "Dirty Harry" with tough cop Harry Callahan's legendary expression 'go ahead and make my day.'

The recent home invasion, shooting and killing of the perpetrator in Oklahoma brings to the fore the need for every homeowner to be familiar with the provisions of the Castle Doctrine in their state.

The Castle Doctrine allows for protection from illegal trespass or violent attack in your primary residence.

"It then goes on to give a person the legal right to use deadly force to defend that place (his/her 'castle'), and/or any other innocent persons legally inside it, from violent attack or an intrusion which may lead to violent attack. In a legal context, therefore, use of deadly force which actually results in death may be defended as justifiable homicide under the Castle Doctrine."


Why you need to learn about it:

1. Not all states have this law. If you use deadly force protecting your home in a non castle law state you could be in big trouble.

2. There are slight variations in some states.

The lady homeowner in OK was lucky because on her 911 call she was talking to a dispatcher who knew the law and basically gave her the green light to use deadly force. She will not be prosecuted for killing the home invader.

Maybe some day all states will take the right of homeowners seriously to defend their home and pass Castle laws.

Some folks of course don't believe in deadly force. That is where non lethal self defense products come in. They are a great alternative and offer life saving protection. Their purpose is to disable an invader and allow you time to get away to call for help or just get away.

This may be seen as some as tough to do. Maybe so! If you believe in the right to defend yourself-one of the principles of free society-but not in using deadly force the choice seems clear.

I urge all homeowners to check their local laws and see where your state stands on this important issue. The information you gain may help you form a strategy for defending yourself your family and your home.

If you don't have the Castle doctrine in your state you may want to get with your lawmakers and get it going-a very worthwhile project.
