The Importance Of An Sr-22 In Florida
If your driving privileges in Florida have been revoked due to an accident or DUI
, you are required to submit an SR-22 to prove financial responsibility in order to get those privileges reinstated. This form is available through a licensed auto insurance company in Florida, and it covers five specific driving related issues: if your license has been suspended, if you have been involved in an accident but did not pay your portion of the insurance claim, if you are under mandatory supervision by your insurance company, if you have been convicted of a DUI (in which case you need to file an SR-44, which is a tougher version of SR-22), or if you've had a judgment against you.
There are a number if options with respect to the kind of SR 22 you can file, depending on whether or not you own a motor vehicle, and each of these can be obtained through your insurance company.
An Operator's Certificate covers the financial responsibility in the case the motorist does not own a vehicle. The Owner's Certificate covers the financial responsibility for vehicles owned by the motorist. The Operators-Owners Certificate covers financial responsibility for all the vehicles that are owned or non-owned by the motorist. Your insurance agency can request an automatic filing, and while the fees may vary, Florida State law requires a minimum of $10,000 for one person killed or injured, $20,000 for two or more persons killed or injured and $10,000 for property damage. In addition, you are also required to have insurance coverage for uninsured motorists in the event of bodily injury and personal injury protection. In the case of a DUI, you are required to file SR-44 with even more stringent requirements of $100,000 for one person killed or injured, $300,000 for two or more persons killed or injured and $50,000 for property damage.
Once your request for an SR 22 is submitted by your insurance agency directly to the Secretary of State, they have 30 days to respond. If accepted, you will receive the SR-22 from the agency along with a letter from the Secretary of State. You must maintain an SR-22 for a minimum period of three years or 36 months, and if you do not renew the form at least 15 days before each expiration date in order to keep your driving privileges current, your license will be suspended again and the process of obtaining another SR 22 must be started from scratch.
If you moving to Florida from out of state, your current proof of financial responsibility will be accepted, providing of course that your insurer certifies in writing that your existing insurance policy complies with the laws of the state of Florida. Be sure to contact your current insurance agent to find out if your out of state policy is valid in the state of Florida. If not, you will have to obtain an SR-22 through an insurance company in Florida. In most cases a simple non-owner policy will be sufficient to restore your driving privileges in Florida.
In order to ensure that you have the correct documentation and proof of auto insurance, it is best to connect an insurance agent to obtain the correct forms and the most informed advice on the SR-22, since driving without a license or insurance is not an option in Florida.
