The Purpose Of The Bail Process
There are certain people who are unable to think straight and they fail to uphold their responsibility as a citizen of the state
. For this reason, there are certain individuals who break the law and commit criminal acts. Individuals who have committed a crime must be put on trial thus criminals who have committed serious felonies are arrested and booked in jail. However, despite all these, criminals still has the right to post bail while they are awaiting their trial.
A number of victims of these criminals are very uneasy about the bail process. They believe that the bail process allows these criminals to roam free despite their crimes. However, the bail process doesn't work like that. The bail process helps defendants obtain release from police custody with the condition that he or she must appear in court for all of his or her trials and proceedings. This allows the defendant to have some normalcy in his or her life before they are charged guilty for their crimes. Posting bail is a process wherein the arrested suspect pays a certain amount of money so that they will be released from police custody after booking. The amount of money is set by a court judge. If the suspect fails to appear in court as promised, the suspect will be arrested.
The bail amount is decided upon by a judge. There are a lot of factors that can influence the judge in making a bail decision. The bail amount may be based on several factors such as the seriousness of the crime, the danger that the suspect poses if he or she is released, the suspect's criminal record, and many more. There are certain times wherein the court judge decides a very high monetary amount for bail which the suspect cannot possibly afford. If such things happen, the suspect can seek the help of a bail bonds agent. A bail bonds agent is backed up by a surety company who can pay the bail bond on behalf of the suspect. However, the agent can ask the suspect to pay the 10% of the total amount of bail. In some cases, the agent may even ask for collateral.
The suspect will definitely benefit from the help of a bail bonds agent. However, the suspect must still show up in court because if he or she fails to do so, the bail bonds agent can send a bounty hunter to look for him or her and bring him or her to jail.
