Tort Law: What Is It?

If someone is injured because of another party's wrongdoing or negligence

, the legal term used to describe the result of the incident is "personal injury." Groups or individuals who suffered a personal injury have the legal right to file a personal injury lawsuit.

These wrongs are considered civil wrongs rather than criminal actions and are called torts. All torts fall under the umbrella of civil law.

Although some plaintiffs may seek to have the defendant imprisoned, it is a relatively rare occurrence. The primary goal of a personal injury lawsuit is to collect moneyor compensationfor the wronged party. Another word for money, in this instance, is damages.

Damages fall under broad categories such as recovering lost income, reimbursement of medical expenses, pain and suffering, and more.

Personal injury law, especially for the uninitiated, can be rather complex. That is one of the reasons that people who want to file personal injury lawsuits should hire attorneys who specialize in that area of the law. Another reason is that an experienced attorney is more likely to be able to win a significantly more substantial personal injury settlement for his or her clients.

Part of the job of personal injury lawyers is to help their clients to navigate through the law.

There are three types of torts - negligent, intentional, and strict liability torts. Your personal injury lawyer will first determine into which category your injury falls. For example, if someone clearly intended to harm you, then your case will be an intentional tort. These are pretty much black-and-white cases, whereas negligent torts are more challenging to win.

Now, if your injury resulted from using a defective or faulty product, or one that was shoddily manufactured, then your lawyer will help you to file a strict liability tort. Your lawsuit, in this instance, will target the product's manufacturer. Your lawyer may even attempt to get in touch with other victims with the intention of filing a class-action suit against that company.

The rewards or settlements from tort lawsuits will vary from one case to the next. In some instances the victims will sue for all of the wages that they've lost. They could also sue for wages that they will lose in the future due to their injuries.

If their injuries will prevent them from returning to their jobs, then the plaintiffs might also sue for money that will be used to provide job training.
