Understanding Bail Bonds In Pennsylvania
Certainly no one wants to be arrested for any reason
, but if you should find yourself in the hands of the law, the first thing you want to do is to get out of jail until you get your day in court. If you have been arrested for a less serious crime in Pennsylvania, after being booked most suspects are allowed to post bail immediately to obtain their release. If immediate bail isn't granted, you will have to remain in jail until a judge determines your eligibility for bail and sets the amount at your bail hearing. You would be wise to have the representation of a lawyer at this hearing.
When determining the bail amount, the judge will take into consideration your criminal history or lack thereof, the severity of the crime, your ties to the community, your potential danger to yourself or others, and any other information the judge considers pertinent. Bail may be waived completely in some cases. There are immigration bail bonds in Pennsylvania for those arrested for immigration matters.
There are three types of bail bonds in Pennsylvania: cash bonds, property bonds, and surety bonds. Cash bonds are funds that are held until the suspect appears in court after which the cash, or portion of cash, is returned. Property bonds are real property, for instance a house, used for collateral to guarantee appearance. Surety bonds are provided by bail bondsmen who guarantee the bail amount for a fee.
Surety bail bonds can be used for any amount of bail. They are most often used by friends or relatives who get the surety bond from a bail agent who will charge a 10 percent non-refundable fee for the service as well as collect collateral to guarantee it. In some cases, only the signatures of two family members with jobs and good credit may be enough to guarantee the bond.
If the arrested party fails to appear in court, a warrant will be issued for arrest and charged with an additional crime. The bail bond agency will be notified regarding the forfeiture of the bail. It is important for family member or friend, or co-signer, to understand that he or she is taking on the responsibility of the defendant's appearance in court since any cash or property used as collateral will be forfeited by the co-signer along with any added expenses acquired by the bail agent. A co-signer needs to be well aware of this responsibility being taken on behalf of the friend or family member before agreeing to it.
