Ways To Calculate A divorce Settlement
Divorce is the dissolution which brings in many kinds of settlements
, emotional ones topping the list. When it comes to "settlement of emotions" as an individual, one has to fight back on his own. However, when the settlement of property and other physical assets are considered, one needs to fall back upon the law of the country.
Referring back to the "Divorce Laws" one will understand the following steps in ensuring a smooth settlement:
1.Assembling the assets: the first step is to calculate all the fixed and movable assets which you and your ex own. This can be done by making a list of the same.
2.Evaluating the property: The next step is to evaluate the property on the day so separation. You also need to consider the debts both of you have either jointly or individually. You have to deduct your debt value or amount from the asset value. And this should be calculated as on the date of separation.
3.Distribution: The spouse with a higher net property value needs to give an equal share to the ex-partner so that the distribution can be made equal.
Fate of Matrimonial Property
The matrimonial property remains out of this distribution as it has been inherited by an individual and not earned by him or her. Apart from this, the gifts, insurances and injury benefits you receive are all secluded from the net property meant for distribution.
The Law to refer
For a clearer underrating you can refer back to Section 25 of the Matrimonial causes Act 1973. This law gives you a wide guideline on the consideration to be made before distributing the property. It also recommends the consideration of the child if he or she is below 18 years of age. This Law recommends the following considerations:
"Income, earning capacity and financial resources of both the partners.
"The needs in terms of finances, obligations and responsibilities on behalf of both the parties.
"The standard of living maintained by both the parties.
"Either of the spouses suffering from any kind of mental or physical disability.
"The contributions made by each partner if both are working personnel"s.
"Equal payment to be made to both the parties.
Is there a way to reduce equal payment?
There is a hardly a possibility of getting rid of the option of equal payment, unless you have taken out ways to prove that the calculations made on net family property are wrong in some way. Another possibility for reducing this payment is when the life of marriage is less than 5 years of age.
Summary:
Settlement of finances while undergoing a divorce is a tedious task and it can be pinching for those who have to shell out half of their earning or asset to the ex-partner merely in the name of "equal distribution". However, if the law demands so, then one has no option but to abide by the same so that there are no further complications standing in the way of marriage dissolution.
