Most everyone knows that the FTC requires that we post disclaimers and disclosures with all our websites But there is a lot of confusion as to what disclaimers and disclosure we are supposed to use.

Unfortunately, there is no "One Size Fits All" answer to this question, as it depends largely on what your site is about.

But rule of thumb dictates that ALL sites should have a Terms of Use document and a privacy policy (including Children's Privacy Policy), at the very least.

The Terms of Use dictates your responsibilities to the visitor and what you will NOT be responsible for, should they misuse the information on your site.

The privacy policy basically tells them how or even if you will use any information about the visitor that may be gathered during their visit.

And make no mistake, with today's technology, even though you may not even be asking them for any information, such as to fill in a form, there is still PLENTY of information that could be gathered about your visitors through the stats programs that come with most hosting accounts.

Information such as, what site they came from to get to yours, what country and region they live in, where they went after leaving your site, how long they stayed on your site, and much more.

This type of information can be sold to marketing companies who study the habits of Internet users, and then create marketing practices accordingly, to sell to other marketers.

And the FTC demands that you divulge whether you either are, or are NOT collecting such data, and what your intentions are to do with it, should you be collecting it.

They are also very concerned about children's right, and how your site may be affecting them. And although there is a lot of confusion as to whether or not you need a "COPPA" document, if your site is not aimed at children, it is our opinion that is better to be safe than sorry.

The FTC will not come after you for displaying a COPPA policy if you don't need one, but they very well might, if they deem you DO need one and don't have it.

There are many other disclosures, disclaimers and affidavits that may well be needed, depending on the nature of your site. But it is a certainty that all sites should, at the very least, prominently display the ones listed above.
